At We Level Up Washington, we are committed to protecting your privacy.  We pledge to obtain your consent before collecting your personal information and to safeguard any personal information you provide.

This Privacy Policy applies to all We Level Up websites, products, and services offered by We Level Up and its subsidiaries or affiliated companies.  Sometimes, we may post product-specific privacy notices or Help Center materials to explain our products in more detail.

Information you provide – When you contact us, we ask for your personal information (including health-related information) to take steps to provide you with services or products you are interested in.  Some information you explicitly provide to us, other information we automatically collect.

We may combine the information you submit to third parties to provide you with a better experience and improve our services’ quality. 

We always allow you to opt out of sharing or using information to the extent possible without restricting the quality of your services.

Cookies – When you visit We Level Up web pages, we send one or more cookies to your computer or other device.  We use cookies to improve the quality of our service, including saving your user preferences and improving search results and ads you see.

We Level Up Washington also uses cookies in its advertising services to help advertisers and publishers serve and manage ads across the web. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services may malfunction if your cookies are disabled.

Log information – When you access our web pages via a browser, application, or other client services, servers automatically record certain information. These server logs may include information such as your web request, interaction with a service, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser or your account.

User communications – When you send emails or communicate with We Level Up Washington, we may retain those communications to process your inquiries, respond to your requests, improve our services, and offer you the right services tailored to you. When you send and receive SMS messages to or from one of our services that provides SMS functionality, we may collect and maintain information associated with those messages, such as the phone number, the wireless carrier associated with the phone number, the content of the message, and the date and time of the transaction.

Affiliated Google Services on other sites – We offer some services on or through other websites with their privacy policies. The personal information you provide to those sites may be sent to Google to deliver the service. We process such information under this Privacy Policy.

Third-Party Applications and Sites – We Level Up Washington may make available third-party applications, such as gadgets or extensions, through its services to enhance your experience with us. Their respective privacy policies govern information collected by the third-party application provider. This Privacy Policy applies only to We Level Up Washington services. Please refer to the respective privacy policies of those sites, as they may place their cookies or other files on your computer, collect data or solicit personal information from you.

We Level Up Washington uses the Google and Yahoo retargeting advertising cookies on AdSense partner sites and certain other services to help advertisers and publishers serve and manage ads across the web. You can view and manage your ad preferences associated with this cookie.

Following HIPAA, HITECH, Privacy Shield, and other applicable laws, We Level Up Washington only shares information only with other companies or individuals outside of Level Up Lake Worth in the following limited circumstances:

  1. We have your consent. We require opt-out consent to refrain from sharing any sensitive personal information.
  2. We provide such information to our subsidiaries, affiliated companies, or other trusted businesses or persons to process personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate and applicable confidentiality and security measures.

We have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request, (b) provide you with the services, (c) enforce applicable terms of service, including investigation of potential violations thereof, (d) detect, prevent, or otherwise address fraud, security or technical issues, or (e) protect against harm to the rights, property or safety of Level Up Washington, its users or the public as required or permitted by law.

Location Data – We Level Up Washington offers location-enabled services (such as GPS signals sent by a mobile device) or information that can approximate a location (such as a cell ID or IP address). We analyze IP addresses in the aggregate for system administration purposes and to gather broad demographic information. We may share this information with the financial institution that issued the credit card with which an order was placed or with law enforcement authorities if we determine or are notified that the use of the credit card was fraudulent.

Health. Your protected health information or sensitive health information may be used by staff members or disclosed to other healthcare professionals, who need to know, to evaluate your health, diagnose medical conditions, and provide treatment.  We Level Up Washington abides by HIPAA and HITECH Act, protecting your information while providing the services you seek.

For example, the results of laboratory tests and procedures will be available in your medical record to all health professionals who may provide treatment or be consulted by staff members.

Following HIPAA and HITECH Act, your health information may also be used to support the day-to-day operations and management of We Level Up Washington, including improving our services and developing new services. 

Required reporting. If required, to remain compliant with HIPAA and HITECH Act, your protected health information may also be disclosed:

  • To law enforcement agencies, without your permission, to support government audits and inspections, to facilitate law-enforcement investigations, and to comply with government-mandated reporting.
  • For court order compliance(s)
  • To public health agencies as required by law. For example, we must report certain communicable diseases to the state’s public health department. Also, we must disclose PHI to the Secretary of the U.S. Department of Health and Human Services when the Secretary is investigating or determining our compliance with the HIPAA Privacy Rules.

Payment. Your protected health information may be used to seek payment from your insurance company(s) (health, dental, auto, or other) and from any other source that you identified that you might use to pay for services, such as credit card, cashier check, personal check and or banking company(s).  This is part of how we can provide services and is entirely within the HIPAA and HITECH Act requirements.

For example, your health plan may request and receive information on dates of service, the services provided, and the medical condition being treated.

Other uses and disclosures of your information require your authorization.  Under the requirements of HIPAA, the disclosure of your protected health information or its use for any purpose other than those listed above requires your specific written authorization. If you change your mind after authorizing the use or disclosure of your information, you may submit a written revocation of the authorization. If our information contains an error or is inaccurate, you have the right to correct it.  If you or your representative authorize us to use or disclose your health information, you may revoke that authorization in writing to stop future uses or disclosures.  Your revocation will not affect any use or disclosures permitted by your authorization while it is in effect.

Where do we process your information?

We Level Up Washington processes personal information, including protected health information, on our servers in the United States of America.

Information security:

We take necessary security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These include internal reviews of our data collection, storage, processing practices and security measures, including data encryption and administrative and physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personnel, including protected health information, to We Level Up Washington employees, contractors, and agents who need to know that information to provide you with the services you are seeking on our behalf.  Confidentiality obligations bind these individuals and may be subject to discipline, including termination and criminal prosecution if they fail to meet these obligations.

Accessing, controlling, and keeping personal information, including protected health information:

When you use We Level Up Washington services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes.  

We ask individual users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests.  

In any case, where we provide information access and correction, we perform this service free of charge. Because of the way we maintain certain services after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems. You have certain rights under federal and state privacy standards such as HIPAA, HITECH Act, CCPA, and other data privacy laws such as state-level Consumer Protection Acts and Privacy Acts. These include:

  • The right to request restrictions on the use and disclosure of your information
  • The right to receive confidential communications concerning your medical condition and treatment
  • The right to inspect and copy your information
  • The right to amend or submit corrections to your information
  • The right to receive an accounting of how and to whom your protected health information has been disclosed
  • The right to be forgotten



We Level Up Washington regularly reviews its compliance with this Privacy Policy and all applicable laws and regulations, including HIPAA and HITECH. When we receive written requests or complaints, the We Level Up Washington policy is to contact the concerned user regarding his or her concerns timely. We will cooperate with the applicable law and regulatory authorities, including the FTC and other federal, state, and local data protection authorities, to resolve any complaints regarding transferring personal data that cannot be resolved between We Level Up Washington and an individual.


By posting any comments, posts, or other material on We Level Up Washington blogs or social media sites, you give us the right to reproduce, distribute, publish, display, edit, modify, create derivative works from, and otherwise use your submission for any purpose consistent with this Privacy Policy in any form and on any media.

                                      i.        Consent to Communications and Monitoring/Recording of Voice Calls and Text Messages Made Through the Service. By providing us with your contact information and using the Service, you agree to receive communications, including via email and phone calls (including text messages and calls made using an autodialer or prerecorded voice message), and push notifications from or on behalf of We Level Up at the email address or telephone number you provided even if that number is on a National or State Do Not Call List. These calls and messages may be for informational purposes, such as to provide you with the information or consultation you requested. Standard text messaging and telephone minute charges applied by your cell phone carrier will apply.

                                     ii.        We Level Up and its services providers on its behalf may, without further notice or warning and in our discretion, monitor and/or record video and voice calls and text message-based communications for our business purposes, such as quality assurance and training purposes and to protect our rights and the rights of others, and you hereby consent to such monitoring and recording.

                                    iii.        IF YOU WISH TO OPT OUT OF MARKETING EMAILS FROM US, YOU CAN UNSUBSCRIBE BY FOLLOWING THE UNSUBSCRIBE OPTIONS IN THE MARKETING EMAIL ITSELF. IF YOU WISH TO OPT OUT OF SMS and MMS TEXTS FROM US, YOU MAY REPLY “STOP” FROM THE MOBILE DEVICE RECEIVING THE MESSAGES. You understand and agree that you may continue to receive communications while We Level Up processes your opt-out request, and you may also receive a communication confirming the receipt of your opt-out request.

Please note that this Privacy Policy may change from time to time. Without your explicit consent, we will not reduce your rights under this Privacy Policy.  We will post any Privacy Policy changes on this page and if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).  We will also keep prior versions of this Privacy Policy in an archive for your review.
